Soviet Style Gun Bill Surfaces In Oregon

Not content with passing the grandiose “universal background check” bill last year that was supposed to solve all of the world’s problems, Prozanski has now introduced a bill that would allow people to declare someone to be having a “mental health emergency”, which would result in a 30 day “hold” being placed on the accused’s ability to purchase a firearm. The accused would not even know they are on the no-buy list, as they would not be informed of the accusation unless they tried to purchase a firearm and go through the background check process. The accuser’s name would not be available to the accused. Worse yet, “mental health emergency” is not defined, and is largely arbitrary.

LC 250 was formally introduced on Friday, January 15th. The bill is officially sponsored by the entire Senate judiciary committee, which Prozansky chairs, because the legislators themselves are limited 2 bills each for the upcoming short, 35 day session. By introducing it as a “committee” sponsored bill, the party in control can use this as a loophole to introduce however many bills they want.

If someone ends up on the no-buy list, and they want to get their 2nd Amendment rights back, they would have to pay out of their own pocket to see a health care provider or petition the courts in order to be declared “not a threat”, then they have to take that documentation to the state police firearms unit. The bill would limit the hold to 30 days, but there’s nothing that prevents the secret accuser from filing another accusation.

As you know, this bill will allow totally unqualified people to make anonymous accusations against others and claim those people are experiencing “mental health emergencies.” Those people lose their rights to buy a firearm.

These accusations will not be investigated, the accused will not know the accusation has been made unless they try to buy a gun nor will they be allowed to know who their accuser is or how long their rights will be suspended.

If they choose to challenge the accusations, they assume the full burden of proving they are not mentally ill and all of the expense.

The Committee approved the bill on a 1 to three vote. All Democrats voted yes, Senator Thatcher voted no and Senator Jeff Kruse is recovering from surgery and was absent.

Today’s vote was not a vote to pass the bill out of committee. It was to formally introduce the draft as a bill.  The next step will be actual hearings on the bill during the coming session in February.

It is interesting to note that another draft is being considered. This is LC 217 which establishes a tip hotline to report threats to students such as “cyber bullying.”  That proposed legislation would require that any tip be investigated to determine if it is authentic. LC 250 provides no such protection for people who will lose their gun rights.

Prozanski, who also serves as a Lane county prosecutor, does not see this as a violation of due process rights, and makes the excuse that person accused can just pay money to the state to be declared innocent. He told KXL radio that the bill will be heard during the first week of the session, which starts in early February.

    Gotta love these “lists”. No due process. And the justification is always “If it saves just one life”.

    So why not mandatory mental health testing? The lock up everyone who is dangerous before they can hurt anyone. If it saves just one life…

    Heck, why not use statistics? The NAACP’s own website cites statistics that half of all black men have served jail time before they are 40 years old. Lock up all black men until they are 40 years old and prevent the half that are criminally predisposed from committing crimes. If it saves just one life…

    That cliff gets pretty steep really quick.

    These “lists” need to be gotten rid of. We don;t want a “No Fly List”, we want an “incarcerated Terrorist List”.

    Oregon already does this with their drivers licenses. Real, non-criminal and non-insane should not fear a 30 day hold (one waits 10 days already…why not 20 more to be safe?)……and yes it could have prevented several of the recent mass shootings. Gun rights advocates blame the person and not the gun for the violence…..this addresses the mantra of the gun rights advocates in that it IS the person and not the gun that it addresses. Only criminals and the mentally unstable would not support denying mentally ill people easy access to weapons. Those who are not flagged as mentally ill would still get all the weapons they want. Seems like only the mentally ill and the criminal would fear this?

      1st driving is a privilege not a right. More importantly the problem with this bill, is that the potential for people to abuse this by making false accusations is high, with no reprucussions for the false accuser. And no remedial action for the falsely accused to get back the cost of having to pay for their rights to be restored.
      Medical professionals, lawyers, and mental health professionals already are bound by law to report if you are a threat to yourself or others.
      This bill let’s anyone make the accusation. So for example, say you piss off your neighbor and they try to get code enforcement to harass you, but code enforcement investigates and finds nothing. They may decide to call in a false accusation just because they can. And then you have to pay to have your rights restored. But can’t sue the false accuser (who is anonymous) to get the money back.

      LMFAO Oregon don’t have a 10 days waiting period for a drivers license..

      For Oregon drivers license you’re granted an interim license at the DMV. You will then be receiving your permanent license in the mail within 10 days.
      The interim card allows you to drive while you wait for your permanent card, You IDIOT.

      And you have the Right to own guns it’s not a privilege. In Oregon you have up to 72hr wait for the background check. If Firearms Instant Check System (FICS) can’t find anything on you in 72hrs they will NEVER find anything on you in the state of Oregon.

      And Oregon has Mental Health Reporting. The only thing Oregon needs is to be able to check other states for mental illness but the privacy act prevents that.
      If Oregon was able to check other states it would have prevented the Umpqua Community College shooter from obtaining a gun in Oregon that had mental illness reported in California.

      Obviously you don’t live in Oregon duo to you don’t know our laws. Or you’re really flipping retarded.

      BTW numb nuts criminals and mentally ill DON’T follow laws, they dont usually go for background checks.
